Anti-smoking campaigns are at the height of popularity, and all over the nation businesses and governments are prompting smokers to "butt out" of their lungs. Gambling, alcohol, and tobacco go together like milk, cookies, and cake, and many casinos have begun to ban smoking, at least on a partial basis.
The Wynn Casino on the Las Vegas strip is second in line to take a tort from an employee in an outrage clouded by a thick layer of smoke. One employee of the Wynn Casino is lashing out against her employer under the pretext that she was continuously subjected to the second hand smoke of the casino's visitors, and would have faced disciplinary action should she decided to cause an outcry over the issue.
She seeks millions of dollars in damages, as well as stronger protections for the employees. The employee alleged that she was not only prohibited from requesting a table in the non-smoking section, but also that casino authorities would not allow her to complain when a patron would blow smoke in her face. She would also have her hand forced into offering gamblers free cigarettes, as well as telling them that their actions were perfectly acceptable.
Amongst her claims were also the health affects she had suffered at the expense of the smokers. Amongst other issues, asthma was her main complaint in the lawsuit. She seeks damages because Wynn Casino would not make an effort to fix the situation, or at least lessen the punishment that her lungs would suffer.
Many casinos have been contemplating a total ban over smoking, but the recession has caused these ideas to be tossed out the window. Gambling and smoking are two vices that always mix, and players and employees alike may just have to contend with the smoke - even if this is not a vice of their choosing.
