iMEGA Files Brief in Kentucky Case

To briefly recap the events so far, the Governor of Kentucky had obtained orders to seize the domain names of 141 online gambling operators. Represented by the Interactive Media Entertainment & Gaming Association (iMEGA) the online gambling operators had gone to court and had won the case in the Kentucky Court of Appeals. The state had then gone in appeal to the Kentucky State Supreme Court, which had given iMEGA till June 1 to submit its brief. iMEGA has now done so on May 27.

iMEGA sources revealed that their brief was a ready earlier but they delayed filing it because they did not want to give the state attorneys more time than required to submit a rebuttal brief. Though this brief covers issues raised earlier, there is one new addition. iMEGA has asked the Supreme Court to review a video tape of the secret proceeding in which the state attorneys obtained the original seizure order without notifying the online gambling operators or giving them an opportunity to represent themselves. In a statement given while filing the brief, Joe Brennan Jr. the chairman of iMEGA, said, “We’re very confident the State Supreme Court will reach the same conclusion as the Court of Appeals. It’s too bad Gov. Beshear wants to keep fighting, but since he’s not paying for his attorneys, I guess he doesn’t care how long this takes or how much he ties up Kentucky’s courts with this doomed campaign.” Brennan was referring to the fact that Kentucky has engaged lawyers under a contingency contract that pays them only in the event of their winning the case.
