An initiative to legalize certain forms of online gambling within California had been started and concocted, spear headed by the Morongo Band of Mission Indians, but has been folded as a bad hand. A collective of gambling supporters had assembled, but the Morongo has pulled the plug on the effort, and the issue is to be dropped.
They had the intent of bypassing federal legislation, the UIGEA, which had actually recently been ruled to give the right to ban or allow online gambling within a state up to that particular state, but they were met with heavy opposition. Anti-gambling associates, as well as other tribal entities, had argued against the issue.
It has been affirmed that pressure from other card-holding tribes had assisted in the final decision. Tribal representative Patrick Dorinson stated that "concerns have been raised," and they want to "address those concerns so this can benefit everyone."
The biggest issue was whether or not the online games would hamper the legality of the gaming compacts and operations operating on land. This would incite the tribes to launch a legal investigation on how the online gaming would impact the tribal gaming compact.
Legislation has been introduced to congress pertaining to the legality of online gambling. Though both the Senate and the House have introduced these bills, it may be some time until we see results. Congress has been flooded with recent legislation surrounding health care and the war, and we may not be enjoying our completely legal online gaming for some time now.
