As of July 30th, the fate of Plaxico Burress still hangs on the horizon. Friend and fellow club hopper Antonio Pierce, Giants Linebacker, may also be facing gun charges along with Burress for the incident in a New York night club last November.
Pierce was present at the time of the shooting. He was also the one who brought his team mate to the hospital. After dropping Plaxico off for treatment, it is alleged that Pierce drove to Plaxico's New Jersey home to stow the gun away before any inquiries were made. Because of his actions, Pierce could stare down the barrel of the proverbial gun. If things go unfavorably for the Giants' linebacker, he could be in the same position as Burress.
Giants' offiicials are up in arms about the potential punishment of their linebacker, despite having condemned Plaxico's actions. The two may share the same fate, though Pierce is being heavily defended by his team. Plaxico has been released by the Giants and remains a free agent.
As of now, Plaxico's case has yet to even reach trial. He is still going through indictment, which will determine whether or not he is to face an actual trial. He has plead for mercy at the hands of the grand jury, but the decision has yet to be reached. If Pierce also comes under fire, this could be a double whammy. New York spent large sums of money to advertise their mandatory sentencing on unlicensed firearms, and as of 2006 this legislation was to be enforced. Plaxico, and potentially Pierce, face up to three years in prison.
Pierce is set to testify in the near future, and this could help or hinder him. Some suggest that Pierce may ultimately end up opening the doors for other charges, such as perjury. Regardless the outcome, proponents on both sides are claiming that he should be forgiven because of the lack of criminal intent, while others are saying that he needs to be punished because he broke the law, regardless of intent.
